This is the agreement between you and Kingfisher Studio for using HiMem. We've written it in plain language, because an agreement you can't read isn't really an agreement.
We believe software should earn trust by being understandable. That's why this agreement is in plain English — if something here surprises you, we've probably failed to explain it well.
The short version. HiMem is yours to use on your Apple devices. Your memories belong to you — we claim no ownership of anything you create. Use it well, don't misuse it, and understand that it's provided as-is. That's the whole spirit of it; the details are below.
We grant you a personal, non-exclusive, non-transferable license to use HiMem on the Apple devices you own or control, in accordance with Apple's App Store Terms of Service and this agreement. The app is licensed, not sold, to you.
Everything you capture and create in HiMem — recordings, photos, videos, notes, and the memories built from them — belongs to you. We claim no ownership of your content. We don't sell it, license it, or use it for advertising or AI training — except where you explicitly ask us to process it on your behalf (for example, to organize a memory). As described in our Privacy Policy, your content lives in your own iCloud account and never enters our custody.
Plainly: we can't see your memories, and we don't want to. They're yours.
HiMem may use AI to suggest titles, summaries, topics, covers, or other ways of organizing your memories. These are suggestions only. They may be incomplete or incorrect, and you remain in control of what is kept, changed, or deleted — AI-derived content is advisory, never authoritative.
In exchange for the license, we ask that you:
HiMem offers optional paid subscriptions through the Apple App Store. Purchases, renewals, billing, and cancellations are handled by Apple under Apple's terms. Free features remain free; paid features unlock additional capabilities. You can manage or cancel a subscription anytime in your Apple account settings.
We may update HiMem to improve it, fix problems, or add features. We may also update this agreement; if we make material changes, we'll tell you and revise the date above. If you continue using HiMem after those changes take effect, the updated agreement will apply.
We work hard to make HiMem reliable, but it is provided “as is,” without warranties of any kind, to the fullest extent allowed by law. HiMem depends on Apple's iCloud and other Apple services; if those services are unavailable, HiMem may be affected as well. Because your data lives in your own iCloud, its availability also depends on Apple's services and your account. We recommend keeping your iCloud in good standing and not deleting the HiMem files unless you mean to.
To the fullest extent permitted by law, Kingfisher Studio is not liable for indirect, incidental, or consequential damages arising from your use of HiMem, including any loss of data. Nothing in this agreement limits rights that cannot be limited under applicable law.
You may stop using HiMem and delete it at any time. Deleting the app removes HiMem from your device; your memories remain in your iCloud account unless you delete them there. This license ends if you stop using the app or if you materially breach these terms.
This agreement is between you and Kingfisher Studio, not Apple. Apple has no obligation to provide support for HiMem. Apple is a third-party beneficiary of this agreement and may enforce it. Apple's standard Licensed Application End User License Agreement also applies; where it and this agreement differ, the terms more protective of your rights govern.
This agreement is governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.
